These General Terms and Conditions of Purchase and the Privacy Policy regulate the use of the website www.makarthy.com, owned by CLOTHINE BUSINESS GROUP S.L. CLOTHINE BUSINESS GROUP S.L. is a limited commercial company with registered office at Calle Granada number 3, 1º F, Malaga, province of Malaga, Spain, with Tax ID No. B93380087. The use of Makarthy's online store services by the customer implies, in any case, adherence to the General Terms and Conditions of Purchase in the version published by Makarthy at the time of the purchase order. Therefore, it is advisable for the customer to read these General Terms and Conditions before making a purchase.

Scope of the contract

These General Terms and Conditions of Purchase apply to the sale of all Makarthy items through its website to consumers who can receive orders in Europe (Eurozone only). Makarthy informs that its website is exclusively aimed at an audience over 16 years of age. Makarthy reserves the right to cancel a user's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.

Purchase limit

For security reasons, purchases exceeding €1500 or with more than 40 items per order cannot be made.

Price

The applicable prices are those indicated on the website on the date of the order. Prices are detailed for each item and include VAT (Value Added Tax). The amount of shipping costs is indicated to the customer in a broken down manner at the time of placing the order. CLOTHINE BUSINESS GROUP S.L. reserves the right to make, at any time and without prior notice, any modifications it deems appropriate, being able to update, even daily, items and prices according to the new developments that appear. In the case of shipments to the Canary Islands, Ceuta and Melilla, the customer must pay the corresponding customs duties, which will vary depending on the weight of the shipment.

Payment

All purchases can be paid by Visa®, Mastercard® or American Express® credit card as well as by 4B Maestro® debit card (which implies an automatic charge). Purchases can also be paid via Paypal, iDEAL and Bancontact. In any case, the choice of payment method is made during the purchase process on the corresponding screen. You must notify Makarthy of any undue or fraudulent charge on the card used for purchases, by email or by phone, as soon as possible so that Makarthy can take appropriate action. Additionally, payment service providers or issuers may adopt anti-fraud measures that lead to the rejection of certain types of operations. Makarthy is not responsible for the application of such security policies.

Delivery

Delivery will be made to the address indicated by the customer, which may be different from their usual residence, and can be sent to their workplace or even to a third party to whom a gift is desired. In any of these cases, the identification of the buyer or the person to whom the item is addressed will be required, by means of an official document that identifies them and a signature on the delivery note. The delivery period set on the page will be merely indicative. However, Makarthy will endeavor to comply with this period, not being responsible if the initially estimated period is exceeded.

Due to specific logistical issues, the products in your order may arrive in different shipments.

Availability of items

All orders are subject to the availability of items. If there are incidents regarding their supply, or if there are no items in stock, you will be informed immediately and we will refund any amount you may have paid.

Guarantee of purchased items

The contractual guarantee offered is that established in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users. Makarthy will be liable for any lack of conformity that becomes apparent within two years of delivery, provided that the customer has informed Makarthy of such lack of conformity within two months of becoming aware of it.

Applicable Law and Jurisdiction

These General Terms and Conditions of Purchase are subject to Spanish law. The parties submit, at their discretion, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the user's domicile.

Returns of promotions

For promotional items involving the purchase of two or more units, if any of the items included in the promotion are returned, the remaining items will be charged at their original price, without considering the promotion, so the discount applied to the set of items will be deducted from the refund.

Discount coupons

Discount coupons cannot be combined with other offers and will not be valid, for example, during Black Friday, Cyber Monday, or sales periods.

Clause on the use of real and synthetic images

Makarthy informs the user that some images included in the catalog, product sheets, campaigns, advertisements or Makarthy communications may have been generated, recreated, retouched or assisted by artificial intelligence systems or synthetic image techniques. These images are for illustrative, commercial and visual ambiance purposes, and do not in themselves constitute an exact or exhaustive representation of all physical attributes of the product. For a correct assessment of the essential characteristics of each item —including, among others, color, tone, texture, drape, pattern, fit, proportions, volume, finishes and final appearance of the garment worn— the customer should primarily consult the real images and the specific description of the product sheet. Makarthy will not be responsible for interpretations based exclusively on synthetic images when the precise product information is clearly stated in the real images or in its commercial description.
